We blogged about the BP Texas City toxic chemical release a few weeks ago. And now, adding to the troubles related to the Deepwater Horizon oil spill in the Gulf of Mexico, a class action lawsuit has been filed against BP. The complaint was filed today on behalf of more than 2,000 people, and is related to alleged releases of benzene from the Texas City refinery in April and May. Schechter, McElwee, Shaffer & Harris, L.L.P. is signing up cases where local residents have sought medical attention for problems associated with the toxic release.
Among the people represented in the lawsuit filed by our friends at the Buzbee Law Firm are ten BP employees. The complaint was filed in Galveston federal court. The plaintiffs in the lawsuit are seeking more than $10 billion in punitive damages against BP. The complaint accuses BP of allowing the release 17,000+ pounds of benzene between April 6 and May 16 of this year from the BP Texas City Refinery. The measurements have indicated that the daily BP benzene release was over 40 times the state reportable level. In addition to Benzene, BP also acknowledges it has released nitrogen oxides, carbon monoxide, propane and isobutene during this 40-day period.
BP has a long and disastrous safety record. We look forward to holding BP accountable once again, just as we did for our clients in the 2005 Texas City explosion and as we are currently doing in the Deepwater Horizon oil rig explosion personal injury and wrongful death lawsuits.
